Interesting. With the exception of Coggins, were any of the cases cited from this century? (From a sociological standpoint, I would suspect the "acceptance levels" from the 70s and 80s are much more restrictive than they are today).

Which precedents do you require to be updated? Sometimes, the courts just agree and decide on concurrence. Old isn't less likely to be true, but more.

I think you misunderstood my point. I'm not arguing against precedent insofar as the free speech vs. disorderly conduct argument goes, my hypothesis is merely that more judges today would be willing to overlook a flip of the bird than, say, all those 1970s midwestern judges were. Society as a whole seems to be more tolerant of all sorts of previously frowned upon behavior - the question is whether the middle finger is included in that shift.

Only judges appointed by Democrats. Maybe not even all of them.

There was another article recently in the news to where a fellow flipped off the cops for the heck of it ,and questions the constitutionality of doing so.
They ask me what my first name was on a quiz question,and I said I don't know ,What TV show ?
