I have been harassed by a collections lawyer for close to 6 years for a medical claim for a visit to an emergency room. The lawyer claims that I was not covered by insurance. I informed the lawyer many times in writing that I WAS covered, that the insurance company indicated that the claim was denied due to late filing, and that they (the hospital and lawyer) are not permitted to continue to bill me.

I showed the lawyer a rejection letter to the attending physician indicating that the claim was denied due to late filing. He has said that he needs a letter about the hospital's specific claim, NOT the attending physician's payment (even though it is the same day, for the same visit). The insurance company cannot even find a claim from the hospital for the specified claim, and the lawyer has never produced a rejection letter due to non-coverage.

I have already missed two days of work fighting this case. At this point, my credit rating has suffered because of this case on my record, as I refuse to settle for which I am not legally liable. I want the lawyer to stop, AND I would like compensation. I am trying to refinance my mortgage, and this irresponsible harassment is impacting my rate to the tune of over $8000.

What can I do? I am desperate.
Since you posted this in the "Open Technical Issues and Requests (Not Legal Questions)" forum, I will give you technical, not legal, answers.
    • Use Caller-ID to ignore the calls.
    • Change your phone number.
    • Buy a shredder to destroy annoying correspondence. The ones that do a cross-cut are best.
    • Move.

BTW, If you post this in an appropriate forum, I'll give you a legal answer that you'll like even less.
