What is the name of your state? louisiana
i recently got an 2nd degree aggravated battery charge. the crime happened when i was 9 months pregnant and laboring. the victim is not pressing charges but the state picked them up what can i expect at trail?

yes, i went over to the apartment where my boyfriend and i lived and he was there in bed with a woman. i proceeded to try to leave and he was grabbing and pushing on me i called 911 and he hung the phone up. i went for the door again and he pushed me so i grabbed a knife and swung at him and cut him across the chest. he drove himself to the hospital and i waited at the apartment for the police to arrive. a month after my son was born i turned myself in and spent a day in jail. they didnt charge me with anything that night so i went home. but im due in court on the 11th of this month.

did the other lady witness the fight between you and your boyfriend?

Did the police arrest you when they came to the apartment? If yes, what were you charged with? Have you seen the police report?

do you have an attorney? If no, get one or ask for public defender representation.

no. the other lady left when i got there.

i was not arrested that night or charged. when my son was 1 month old i turned myself in to the police. i was charged with 2nd degree attempted murder then my attorney got the charged dropped down to aggravated battery.

i have never seen the police report.

should i plead guilty or not guilty?
the victim never pressed any charges but the state did.

A. I haven't spoken with my attorney since the day i got out of jail. I've only spoken to her answering machine. So she hasn't advised me how to plea.

I dont understand. you were not arrested or charged the evening of the attack. What made you feel you had to turn yourself in to the police? Did someone tell you that criminal charges were pending?

Are you still with your boyfriend, the one you attacked? Is he willing to stand next to you and request the DA drop the charges?

the detectives that were dispatched out that not let me go home. they talked to my mom and because of the situation they felt bad and didnt wanna take me in so they asked that i turn myself in a few weeks after i have the baby in which i did so i could be formally charged.

i still communicate with my ex boyfriend hes still trying to be apart of my life and im sure he would talk to the d.a. if he thought it would get the charges dropped. the attorney i was using when i went to jail had him sign an affidivant stating he wanted the charges dropped.
