What is the name of your state? California
Five years ago and then again last week I was arrested for shoplifting - petty theft (less than $40). what is likely to happen? I am an adult and have no other criminal record. Is there anything I can to convince the judge I have learned my lesson and will never do it again? Do I need a lawyer? Repentant

Were you sentenced to any jail time for the prior theft? If so, then this crime CAN be a felony (PC 666) in California. If not, then you still face potential county jail time, probation, and fines plus restitution.

Chances are you will not go to jail over this. But you CAN expect hefty fines and restitution as well as another $250 or so in a civil assessment to the store in question.

After arraignment, if you cannot afford an attorney, the court will appoint one for you.
