    666pc.

    What is the name of your state? California...Hello.I was charged with a 666pc. I was arrested at a Sears in Los Angeles for taking A $50..00 Box from the tools area. My bail was $20,000.00. I had a prior conviction for a petty thieft in 1985 at a kmart. What am I looking at ?

    From the Penal Code:

    666. Every person who, having been convicted of petty theft, grand
    theft, auto theft under Section 10851 of the Vehicle Code, burglary,
    carjacking, robbery, or a felony violation of Section 496 and having
    served a term therefor in any penal institution or having been
    imprisoned therein as a condition of probation for that offense, is
    subsequently convicted of petty theft, then the person convicted of
    that subsequent offense is punishable by imprisonment in the county
    jail not exceeding one year, or in the state prison.


    And,


    18. Except in cases where a different punishment is prescribed by
    any law of this state, every offense declared to be a felony, or to
    be punishable by imprisonment in a state prison, is punishable by
    imprisonment in any of the state prisons for 16 months, or two or
    three years; provided, however, every offense which is prescribed by
    any law of the state to be a felony punishable by imprisonment in any
    of the state prisons or by a fine, but without an alternate sentence
    to the county jail, may be punishable by imprisonment in the county
    jail not exceeding one year or by a fine, or by both.


    Or,

    19. Except in cases where a different punishment is prescribed by
    any law of this state, every offense declared to be a misdemeanor is
    punishable by imprisonment in the county jail not exceeding six
    months, or by fine not exceeding one thousand dollars ($1,000), or by
    both.


    They will likely charge the felony and offer a deal to a misdemeanor.
