I have a family member that was recently accused of theft @ the work place. During her shift an retail item worth approx. 16,000.00 disappeared. She thought nothing of it until the CFO and Marketing manager (both males) Cornered her in a tiny office and told her that they had incriminating video footage of the theft, and that if this problem wasn't resolved by the next bussiness day the police would be involved. She DID NOT steal nor help anyone take this merchandise. SHe asked that she may see the footage and they refused. She was very upset and put out by this and worked her next shift, still handling merchandise of the same value. She decided that she did not need to work for a company that would accuse her of stealing, and she quit. This was last week. She got a call from the city police where the merchant is located and has been asked to come in for questioning tomorrow, and that they have video that she was involved in this theft. We do not know what to do. She was actually going to file unemployment and contact a lawer about the way she was threatened and approched originally but hasn't had a chance. HELP!!

A video of the theft is compelling evidence. Sounds like your "family member" should retain an attorney.

She handles this type of merchandise on a daily basis. It was her job to handle it. If they had video of it in her hand it would mean nothing except she was doing her job. There can be no evidense if no crime was commited. The only problem is she does not have a wad of cash to go into a police department with an attorney. we got a quote for $1000 just to have counsel present with her. We need I guess possible scenerios, or what to do with not much money for counsel. If they had compelling evidense why wouldn't they just issue the warrant? If we pay for counsel and this turns out to be nothing (which it is) Can we counter sue the private company for defermation of character and court cost, or something to that extent?
