My boyfriend was arrested for aggravated assault. He was at a college dorm and left to take a friend to get a taxi. While he was on his way a car stopped in front of him to talk with their friend. My boyfriend honked his horn and they started yelling at him. As they stepped out of their cars (there was 5 guys and 3 girls with them) my boyfriend also got out. He had a bat in his car and he had that in his hand because there were five of them and only one of him. Not even two minutes later the police were there and arrested him. He didn't raise it or threaten them with it and he was at least 15 feet away from them. Do you think he will do jail time or get probation? He has no previous record at all.

Whenever one person makes a willful attempt or threat to injure someone else, and also has an apparent, present ability to carry out the threat such as by flourishing or pointing a dangerous weapon or device at the other. An "assault" may be committed without actually striking or injuring another person.

Your boyfriend couldn't have been charged with aggravated assault unless he'd actually hit somebody with the bat.

Either you have the charge wrong or he's giving you a lot of hooey about what actually happened.

So being charged with aggravated assault is correct, that is what was written up on his arrest report, along with the details.
