What is the name of your state? Florida Where does the burden of proof lie in the case of a person being wrongly charged with aggravated battery when it very well could have been an accidental injury or self defense and it is his word against 2 others when all involved had been drinking?

**A: how much were the 3 drinking and would such amounts be deemed to cause the 3 individuals to be adjudicated as legally intoxicated in the court of law?

Persons involved consumed at least 6-8 beers each. Also would like to know if there is a minimum mandatory sentence in Florida for this charge and the odds the charge being reduced to a lower if person charged has no priors of this nature? Thanks
