This happened in ARkansas.


John was working out in gym that is on the campus of a public institution that is funded both by the state and the government. He wears sandals while working out. The policy of the gym is: no sandals while working out. So he stopped working out and sat down to rest. A few minutes later, Jack, an employee at the gym tells John to leave because he had sandals on. ( John was not working out when Jack told him this. ) John smiles and says "OK," and left after an hour. A week later, John comes back, wearing sandals. Jack this time rushed in a very rude and aggressive way and told John that if he does not leave, Jack have the authority to make him leave. John spoke with Jack's superior, Joe, who told Jack to stop harrassing John. John accused Jack of being discriminative toward his foot apparel (sandals.)

A week later, John began to wear tennis shoes. John saw Jack passing by a few times, being the nice guy he is, he showed Jack his tennis shoes, so as to let Jack know that John is doing what he asked him to do - wearing tennis shoes. However, Jack says to John, in front of all people working out in the room, "F*** YOU, N*****. You might get hurt." There were a lot of African American people in there, John is confused whether that comment was made to him, or to African Americans. In either case, John is confused about what made Jack saying what he said.


Furthermore, John thinks Jack is a neo-nazzi and a modern KKK possibly. What should/can John do to protect himself from a possible assault? Is it possible to look at Jack's criminal background? Can John obtain an Order of Protection?

John needs to find a new gym to work out in and when he does, he should:

1. leave his attitude home.
2. learn & follow the rules from the start.
3. If he is asked to leave, do it when asked, not an hour later.
4. Stop using race to explain why people don't like to deal with his obnoxious behavior.

1. How do you come to the conclusion that John has an "attitude?"

2. How do you know John did not "learn & follow the rules from the start?"

3. Why should John leave immediately, just because a staff told him to in a rude manner?

4. How do you know John used race as his "explaination." Furthermore, how do you come to the conclusion that John has an obnoxious behavior?

Because, reading between the lines, it is obvious that John believes he should be the exception to the rules and that the earth should revolve around him. This is why, rather than drop the issue once he is finally in compliance, he feels it necessary to stir the pot by going out of his way to point out his new shoes to Jack. He didn't do this on the side, in an apologetic manner, where it was just him and Jack. He chose the sarcastic method, while in front of other guests at the gym. In fact it would appear by your post, that John waited for just the right moment to display his arrogance. Since he saw Jack pass by, "a few times", before he went into action. Additionally, when Jack first asked John to leave, you had to point out the fact that "John was not working out at the time" as if to say he was "in the right", due to his interpretation of some technicality. Then to show a little more "attitude" he sits around for an hour before he leaves. I guess that was when John was finally good and ready to, rather than when he was asked. Finally, only "attitude" would bring John's drama up to this level and then look for approval at a free legal advice forum.

Because he was in violation of the rules and so he was asked to leave. You must be a moron to believe John has any legal leg to stand on, as far as not leaving when he was asked to, by a staff member..

Do you read what you post? Specifically the following,
"John accused Jack of being discriminative toward his foot apparel (sandals.)" just a little bit of a smart a$$ comment I suppose.
"There were a lot of African American people in there," and for the finale, "Furthermore, John thinks Jack is a neo-nazzi and a modern KKK"

As far as his being obnoxious, besides what was already covered above, you don't mention anyone else having a problem with Jack, not any other African Americans or anyone from any other race.
Only John,,, yes John, "being the nice guy that he is" is the only one who has this problem with Jack.

But then,,,, John was probably the only one who thought the rules didn't apply to him.

However, what if Jack has a criminal background that was not checked when he was employed? If Jack is ineed in good relationship with everyone around him at work, why would Joe radio him to stop harrassing John upon John's simple conversation with Joe?

Irrelevent and not illegal even if he is.

Stay away from Jack, don't engage him in conversation, and be polite - not condescending or obnoxious.

Sure. if you post, we can look at it. :D

His criminal history is irrelevent here. Has a crime been alleged?

Can John obtain an Order of Protection?
He can try. But chances are that won't happen in this circumstance. This is an issue for the management to deal with, not the court. The management will either decide that you are not welcome or they will decide that Jack needs to cool his jets or be terminated.
