What happened was one night at a club I was with a few friends. One of my friends and I had noticed that there was a guy that had been staring in our direction looking pretty pissed off all night. I guess this guy was dating a girl that my friend had hooked up with.

The guy staring at us all night is the victim, and had his friend come over and verify who my friend was, and once he found out his name flagged him over. This is when everything happened.

He got in my friends face yelling and was very hostile, asking why he was texting his girlfriend. My fiance was there with me and she moved behind me(She was 4 months pregnant). I had been standing there the entire time and I politely said to the guy, "We aren't trying to have this tonight, calm down".

That is when he turned to me, put his left hand on my upper right chest, said "**** you bitch", pushed me backwards, and began to throw a punch.

When he pushed me, he pushed me into my fiance. I noticed him starting to throw a punch and I quickly threw one and he dropped. After this I took a few steps back because I had no idea where his friend was and didn't feel like getting hit with a bottle. The bouncers quickly broke it up and I waited outside until the cops came to take statements. I was later summoned to court.

The hearing is tomorrow. Him and his witnesses say that I sucker punched him and hit him out of no where, and then after striking him tried to run out the door before being grabbed by his friend, and the bouncers.

For starters, I do not understand why I am the only one who is receiving charges, as he instigated a confrontation, verbally assaulted me and physically assaulted me and my girlfriend due to his push. I simply defended myself. I am a trained fighter, and have been boxing since I was 8 years old. I am being punished because my reactions were better?

Also, as I was waiting outside for the cops, he came out and saw me and rushed at me again to try and start another fight, and was escorted inside the bar by the bouncers. The following Thursday at another club, he ran up to me and a bunch of friends again trying to start stuff, but was pulled away before he got to me by friends and bouncers. After he calmed down I talked to him and he told me that the cops came to his house and wanted him to write a statement, but he wasn't a punk so he didn't press charges. Yet, this has already been extended and I saw him in court with his two witnesses.

One other thing, is the cops tried to contact his girlfriend multiple times, who eventually called the cops and told them she did not want any part in this. She had also told him the night everything happened to not come up to us and start problems, but of course he did not listen nor seems to of learned his lesson.

Like I said, I do not understand why I am being charged with Assault, or am the only one. If I sucker punched him like they all claim, then how is it he suffered injury to his FRONT upper left lip? He had to of turned to me which just solidifys my story, correct?

They are asking for a pretty little fine, restitution, and a charge of assault on my record. This is absurd to me. On top of it all, they are not asking for any jail time, so I do not qualify for a court appointed attorney, nor do I have the cash to dish out for one.

If anyone has any suggestions, tips, words of advice, I'd really appreciate it.

Retaliation does not equate to self defense.
You got into a bar fight and nothing you say indicates you are not guilty of assault. The fact that the other guy wasn't charged doesn't make you less guilty. "He hit me first" didn't work with your mommy and it certainly does not work in a court of law.

You need a lawyer.

You need better witnesses and FYI, if you're going to defend yourself, next time let the other guy throw his punch. If you're that good it won't connect and now you can defend yourself. What you did here was respond to being pushed.
