What is the name of your state (only U.S. law)? NC
Is it legal for a student to audio tape other students if he is standing in the group? What if the student is in an office with a faculty member speaking about something the student did wrong. Is it legal for the student to tape the conversation without the faculty member's knowledge? The student did this while he was being told that they know he was cheating on a test. Now he's taped the conversation without the faculty member's knowledge and wants to use it to go to the Dean. The student also audiotapes conversations when he's in a group of other students during breaktime without the other students' knowing he's taping.

North Carolina is a one-party consent state. That means that one person involved in the converstation must be aware of the taping. (NC 15A-287) So taping a converstation that you are involved in is not against the law. However, it may be against the school policy so you need to double check that. You could face disciplinary action from the school for that violation. In a group setting, so long as you are activly engaged in the converstation as an equal party it is okay to record. That means you can't just walk up to a group say "hi" and then record them without their knowledge.
