What is the name of your state?What is the name of your state?California. I am curious to know what the statue of limitations are on bigamy. Here is the situation. Before my mom's present marriage she was (or thought she was) married to a guy for twelve years. He had told her the his marriage to his first wife was not legal because she was not of age. Well my mother divorced this man about twelve years ago but recently found out that he has never divorced his first wife. He married again and still has never gotten a divorce from his first wife. My mom wants to know what the statue of limitations are on bigamy and does she have a case? If she does can she also sue?

My response:

What?

"A case" for what? Your mother is divorced from him - - and has been for 12 years. At the very least, and since she "believed" that she was married, then she had "putative spouse" status, and that status gave your mother the same entitlements as if she was, in fact, "legally married." So, what is she thinking she's going to gain - - assuming she had some sort of Cause of Action in the first place?
