I believe that you are confusing CHARGED with TRIED. A person can be CHARGED for the same crime multiple times in SOME cases. It all depends on HOW the charges were dismissed the first time. Were the charges dismissed WITH or WITHOUT prejudice?

You can also be CHARGED twice if you commit the crime twice.
