Can you sue a police department for false arrest? My husband was arrested for two crimes that he did not commit. The suspect was described by two witnesses in both instances. Both descriptions were basically the same. However, my husband's physical description was opposite from what they had reported. My husband gave proof to his whereabouts at the time the crimes were committed. He had several witnesses who were prominent people in our community who could testify to where he was. But, the detective did nothing to check out his story and arrested him. Also, the front page of the paper stated that they had caught the person who committed the crimes and put my husband's name as the person who had done it. I thought you were supposed to be innocent until proven guilty. The police and the newspaper have made him guilty even though he is innocent. We have gotten signed affidavits from several people so we are sure that the case will just be dropped, but the damage has already been done. What can we do??????
