charged with petit larceny What is the name of your state (only U.S. law)? virginiaI was charged with petit larceny in 2004 and completed a year of probation and alcohol prevention classes after which the charge was dismissed in 2006. During the probation period I was arrested one more time because I was late (second time) for alcohol prevention classes. I have been free of any other charges since then and I have completed a two year medical radiography course in Virginia and am licensed to practice by the state but I am unable to find a job as the arrest information is there on my background record. What can I do now. Thank you in advance.What is the name of your state (only U.S. law)? |

| Well, it is a misdemeanor and so you have been convicted of a crime. However, you will not have to include this on your application after 5 years from your conviction date since the statute of limitations for petit larceny in Virginia is 5 years. Just keep looking for a job in the meantime. |

| I thought I misunderstood his post the first time I read it. So I re-read it. And that was a mistake. Because I realized that he meant it, which ticks me off to no end. This forum is a great service - I've seen y'all help a lot of folks. But I fear that if the forum is taken over by these yahoos whose legal knowledge comes from watching court-tv marathons, that people needing help will stop coming here. My legal background is limited to tax law -- working 10 years as a legal assistant convinced me that my talents lay elsewhere. So I limit my posts to questions, and an occasional post in the military issues thread, as I have current experience in that field. It kills me when posters who are taking nothing but un-educated guesses give such blatantly wrong information. Although lately my posts seem to be aimed at those who leave me shaking my head in disbelief.... Who is it around here who has a front porch and a cold beer? I believe I am officially in need of one now! |

| I will assume that you got some sort of diversion program which dismissed the charges after completion of the program. It is that or you got a stay of execution. Do you know which? Also, the 2nd arrest was a technical violation and not a criminal charge? correct? When you look up your criminal record, does it show one arrest and one dismissal, or 2 arrests and 2 dismissals or what? Please explain exactly what info. is available to anyone checking your backround and what the dispositions are. I will be able to answer your question more accurately with complete info. |
