Better way to deal with this...have your lawyer deduct all the money on the checks from her share of the marital assets......

Rather then procecuting her....she be even more pissed at you this way!

Was this a joint account?
Did she have signature rights on the account?

If the answer to both is no, then you need to go to your bank and demand that they refund the money back into your account. They have a fiduciary responsibility to protect your money by verifying your signature for EVERY check. If they breach that responsibility (and banks have made the business decision to NOT check signatures to save money), the loss is theirs.

And then, go to your local police and file a forgery complaint.

Oh, and lets not forget that Wisconsin IS a community property state, so maybe she only stole HALF the money.

This is rockrover:

It was my sole account because she has done this before and we both agreed that she cannot handle money.

When I was on training the week she stole my checks, she went partying, stayed at different casino hotels, gambled, and blew over $1,100.00 only to say "I can't help myself from stealing money". Oh ya, by the way, she's facing sentencing for stealing over $10,000.00 from her last employer.

Yes, she is (was) my wife and I love her, but I cannot keep enabling her to continue like this. I've spent 9 years trying to help her and now I have to file for chapter 11. She is an active drug addict and she is facing 10 years in prison.

It's tough love and GOD knows I love this women, but when it's over, it's over and want my son and my house.

Should I go to the FBI?

Think of your wife this way....you buy a stock for 50 it goes up to 70 but instead of selling you keep it, then the shhiittt hits the fan and it drops to 30, so you still keep it becuase you know its a good company andthey have a good product but they cant seem to get their act together.

Then it drops to 20 then to 10, so you give up and sell it......then what happens?

will it go back up to $70 or will it go to 70 CENTS?

To Johnny2:

it's worth 70 cents currently. It can be $700 if she wanted it to be, but she does not. Drugs have her in a different reality and I won't be seeing her for 10 years anyways. I need to protect myself financially and legally. Besides, everything I've done over the past 9 years has failed and what she is facing is her last chance or she will end up killing herself.

To get me out of her way, she lied to the judge to get me kicked out of my own house and now I can't even see my son. I WANT MY SON, age 5, out of that lifestyle.

Thanks for dialog!!!

furthermore;

I am still waiting for the bank to get the copies I need for the Affidavit of Forgeries. I expect them to come in this week then I can give them to the DA. Note: this will be bail jumping for her from similar pending charges. GOD this hurts.

Thanks........

Unfortunatly that is why we have such a big drug problem i this country, we string along drug uses for years then finally they hit a brick wall and either get help or commit suicide.

By lowering the purity of drugs, and by making it illegal we CREATE tons of paperwork and clog up the courts, and ruin peoples lives like yours for years.

If we as a Nation were smart, we would leaglize drugs, have safe houses where the addict can use drugs, and instead of 9, 10 15 20 years of being stung out it can be done in 2 or 3 years, the amount of police time would be save dramatically, the courts would have a lot less cases, so others can really have swift justice..instead of 6 years on a personal injury suit...

The benefits of legalization is tremendous for the non drug user in this country, but who is going to be the FIRST to say: "I want to lay off 100,000 police officers for a lack of crime"?

the only downside we have to accept is a quite a few drug addict will die, but then again look at all the drug rehab and social workers that will lose their jobs too......

So in a perverse way there are maybe millions of jobs created that require drug users to ruin their families.
