My response:

I think the phrase you're looking for is "circumstantial evidence", and the answer is "Yes". Criminal defendants are regularly found guilty on "circumstantial evidence"; i.e., it's the old "if it walks like a duck, quacks like a duck, then it must be a duck" evidence.
