So theres a party, underage drinking. A guy and a girl start messing with eachother by play fighting and wrestling. All of sudden girl bites the guy very badily and the guy throws her off of him, then pushes her. The cops are called reports are written. Less than a month later police arrive at the boys house which is in a different city than where this incident occurred and is arrested on the spot due to a warrant. Bond is set at 10,000 and the charges are from the state.....Is the boy able to press charges on the girl for biting him? He has pictures of the mark and bruises from when it happened and the bite mark is still clearly visible now. No one really knows whats going on or why the bail is so high or why the warrant was issued. According to the girl she didnt press charges, the state did.

Typical. Given the bond amount, I suspect this is a misdemeanor charge.

He can call the police and report it. They may just add it to the original report. However, I'm guessing that came out originally and apparently the DA decided that her biting him was either defensive or inconsequential. Or, it was never mentioned at the time. If it was never mentioned, bringing it up now might not work too well.

However, before he reports this to the police he may want to consult an attorney as he might say something they can use against him in court later.

No one really knows whats going on or why the bail is so high or why the warrant was issued.
Let's see ... the officers wrote a report, they submitted it to the DA and the DA found there to be sufficient evidence to support the allegations of battery or domestic violence against the male. The bail is not all that high. In my state that would be a high grade misdemeanor or a very low level felony. I am not familiar with the bail schedule in NM.

According to the girl she didnt press charges, the state did.
In point of fact, it is ALWAYS the state that presses charges. A person can ask that charges be pursued, but only the state - through the DA - can press charges. In the case of domestic violence cases, the state will often pursue charges even if the victim declines to prosecute.

Okay this is the whole story.... everyone was drinking heavily....the boy and girl where wrestling like I said above then the girl bites the boy hard and he thows her off and she hits her head... the boys girlfriend comes towards the boy and slaps him and he hits her back. The cops are called and each girl gave their statement... none of the girls pressed charges. He was already on probation for a DUI and broke probation when his PO came to his house for a visit she found beer bottles and called the police.. once again he was arrested. Now this happened... his charges are envading a police officer (middeam..) and now he has felony charges for assault and battery on a household member

Sounds like he has some problems and cannot seem to stay out of trouble!

Who is this fellow to you? Are you the girlfriend?

The fact that everyone was drinking does not excuse his actions. The fact that the girls did not ask for charges or want them is irrelevent. At this point he needs an attorney.
