What is the name of your state (only U.S. law)? Illinois

I allowed someone to stay in my house to house sit while out of town. He trashed my home and property doing over $5000 worth of damage. I tried to file a criminal complaint and was told by the Sheriff that because I had an agreement he could be in my home this was not a criminal offense. The Illinois Statute regarding Crimnal Damage to Property does not make that distinction. Is this a criminal offense?
