I have a criminal law case to solve for university and could do with some help as my degree is in BusinessEconomics!

ok here we go:

Andy is employed as a lifeguard by Scarby Sands local authority to use reasonable endeavours to potect the life of bathers between the hours of 09.30 and 17.00. One day Andy saw a swimmer in distress. He swam out to save him, but as he got nearer he recognised the swimmer to be Brian, who had recently taken Andy's girlf from him. Andy decides that he would leave Brian to drown and swims back to the shore. Cecil who witnessed the whole event swum out and brought Brian back to shore. When Andy first swam out to Brian, its was 17.05, but due to his watch having stopped he thought it was 16.45.

Consider teh above facts in relation to Andy's criminal liability in the following two alternative conclusions:

A) Brian survived thanks to the excellent treatment at the nearby hospital, but was seriously brain damaged due to the length of time taken to rescue him.

B) Brain awas the taken to the nearby hospital where the diagnosis was that there appeared to be nothing seriously wrong with him, but that he should be kept under observation overnight. During the night a junior doctor mixes Brian's medicine up with those of another patient. As a result Brian is given an injection of a chemical to which he is severly allergic. He dies as a result of this injection six hours later.

Any help would be much appreciated taking into account- duty to act and omissions etc...
Cheers, Katie
