state? Texas. My Brother,17, was convicted of criminal mischief in Feb'97, At the time (Supposedly) it was a class A mis. I cant find proof anywhere that it was, but what I did find is that the the range of punishment for his case was decided under a 3rd degree felony.
He unknowingly plead guilty and was given 7 years. I say unknowingly because the document asks if he is mentally capable of making this decision. They ordered a psyc eval that states he reads on a 5th grade level, and no one explained to him what he was signing.
What I'm trying to find out is....was this criminal mischeif bill passed AFTER sentenceing. and if so, do we have grounds for a case. I have also found type errors in the documents he signed.
no spellings or punctuations have been changed...
it reads...I state to the Court that I am freely and voluntarily entering may plea and that I am mentally competent.
"may" could be misleading couldnt it.....for someone with a 5th grade reading level??
