My son received a disorderly conduct citation in the mail today from a St. Patrick's Day party that he had at his apartment. The local police came to his apartment because they were in the neighborhood on another complaint and could hear his party in the street. He went down and talked to them and they wrote his name on a piece of gum paper. At about 2:00am they came back and he went down to talk to them. They followed him up the stairs to his sixth floor apt. he went inside and told everyone that the police were there and they needed to stop (which they did). The police asked him to come into hall where they pushed him against the wall and told everyone that he was being arrested. They then went into his apartment and walk around. They asked where his ID was and he said it was in his pocket, which he tried to get but they pushed him back against the wall and reached in the pocket for it. can the police enter his apartment without consent? I'm not sure if any complaints came from the neighbors, or if the police themselves were complaining. what are his options?

The police heard the noise from the street .

Spoke to him and eventually the police and him went up stairs , he opened the door .

Yes , the police could enter once the door is open .

He is in charge of his apt. and what goes on in it and around it .

He will most likely pay a fine .

Looks like they told him to lower the noise

At about 2:00am they came back and he went down to talk to them
They came back because he failed to do what he was told
