I read the 48 hrs story too:) Because the appeals court remanded the case for a new trial...this was due to prosecutorial misconduct...I think the girlfriends testimony was the nail in the cops coffin on that one...that and the sexual abuse of the daughter...

are you asking how, under law, could they retry or how, on the basis of the appellate court's decision, they could retry the case?
