I received a subpoena to testify for the state of delaware against my husband. What would happen if I just flat out refused to testify against him. It is a domestic violence situation in which I have forgiven my husband and do not want him to be given a jail sentence. Is it possible for charges to be dropped for time already served which is approx. 4 months? He is currently in jail due to the fact we cannot afford the high cash only bail. I know if I testify on the state's behalf that it will be bad for my husband and I just want to be able to get on with our lives. Any help you can give me would be greatly appreciated

If you don't show up for trial and testify truthfully, you'll go to jail for contempt. That you have forgiven him carries little or no weight. Abusers are often forgiven multiple times before they kill their victims. The spousal privilege does not apply when one spous is the defendant & the other is the victim.
