My friend, Travis was involved in an arguement with his homosexual partner, John, and it turned violent. Nobody was in the room to see who struck first or how it started, but in the end John was bleeding and bruised and Travis had very little injury at all. When the police arrived, John claimed that he hadn't struck Travis at all and that Travis had just started hitting him. Due to the injuries on John and the lack of a witness to say that John hit Travis at all, Travis was arrested for domestic battery. We were told as they took him away that he would probably only spend the night in jail because they were carging him with a misdemeaner and it was his first offense, but the court is keeping him in jail for the next 8 days until his court date. I visited him last night in jail and he had no idea who his lawyer is (he requested one) or what he can do. Neither he or I or any of our friends are familiar with what to do, and I'm at a loss for how to help him.

Please, I could really use some kind of advice.

A: Yes, if that's the rule.




Standard answer

Here are some hints on appearing in court:

Dress professionally in clean clothes.

Do not wear message shirts.

Don't chew gum, smoke, or eat. (Smokers...pot or tobacco...literally stink. Remember that before you head for court.)

Bathe and wash your hair.

Do not bring small children or your friends.

Go to court beforehand some day before you actually have to go to watch how things go.

Speak politely and deferentially. If you argue or dispute something, do it professionally and without emotion.

Ask the court clerk who you talk to about a diversion (meaning you want to plead to a different, lesser charge), if applicable in your situation. Ask about traffic school and that the ticket not go on your record, if applicable. Ask also about getting a hardship driving permit, if applicable. Ask about drug court, if applicable.

Here are six stories that criminal court judges hear the most (and I suggest you do not use them or variations of them):

1. I’ve been saved! (This is not religion specific; folks from all kinds of religious backgrounds use this one.)

2. My girlfriend/mother/sister/daughter/wife/ex-wife/niece/grandma/grand-daughter is pregnant/sick/dying/dead/crippled/crazy and needs my help.

3. I’ve got a job/military posting in [name a place five hundred miles away].

4. This is the first time I ever did this. (This conflicts with number 5 below, but that hasn’t stopped some defendants from using both.)

5. You’ve got the wrong guy. (A variation of this one is the phantom defendant story: “It wasn’t me driving, it was a hitchhiker I picked up. He wrecked the car, drug me behind the wheel then took off.” Or, another variation: “I was forced into it by a bad guy!”)

6. I was influenced by a bad crowd.

I'll pass onto Travis something I learned as a schoolboy -

I always let the other guy throw the first punch. The can of whoop@$$ I open is then not only justified, but good motivation to give what I've already gotten.

C'mon, play nice.

If I might direct your attention to the disclaimer below all of my posts... I offer the advice of someone using commone sense.

If confronted, make all efforts to negotiate an amicable end to the conflict. If said end to conflict cannot be achieved, and the agressor refuses to back down, allow said agressor to make the first move toward physical attack. When attacked, make every attempt to flee. If flight is not an option, you will have to meet force with force. Should said aggressor produce a weapon of any kind, feel free to draw your fully licensed 9mm Glock and pull until the clip is empty. Reload and empty another mag into said slimeball. When questioned by police regarding the 15 rounds in the floor underneath the deceased, inform the investigating detective you are a perfectoinist. :D
