dui ? while in the passenger seat!

In the state of Illinois can you get a dui when your not driving? My daughter did yesterday. The police had her walk the line and blow! She was legally drunk and then some ,but not behind the wheel.Whats a mother to do?

in other words if she was indeed in the vehicle, who else was with her? The police may have suspected that she switched places with someone else if so...

Were the keys in the ignition? If so, she doesn't have much of an argument. You don't have to be driving the car to get a DWI.
