During my preliminary hearing, there was 2 witnesses that testified against me. My question is - when the first one was up on the stand testifing, the second one sat at the table where the District Attorney was sitting. The second witness heard everything that the other one had been asked and everything that he had said. Is that legal? Please give me an opinion or what I could do.

Thank You.

If it was federal court and the otehr witness was representing law enforcement, the answer is yes. The governement is allowed one law enforcement person to sit at the table. (I guess it is like the plantiff in a civil case.)

Also if no rule on witnesses was requested, then anyone can stay.
