My friend had been monitored for months leaving work early. He worked at a state facility where you have to sign in and out in order to leave the building. Security had been monitoring him coming in very late and leaving very early over a period of 6months. They fired him, he knew what he did was wrong and hes sorry for it. The company calculated that he owes them $10,000 because he reported on his weekly time sheet 40 hours per week as worked, but never did work all 40hours in reality. They are threatening to press formal charges for theft/fraud. He spoke with the company and asked if they would allow a payment schedule so he could pay back the money and that they not press charges. The company set terms as wanting $5000 up front and they will give him 6months to pay the balance. Unfortunately hes broke, his house just went into forclosure as he was denied unemployment and hes been w/o work for 2 months, he just plain dosen't have a nickel to his name although he did manage to find a job a few days ago paying $15.00/hour. My question is, can the company press charges and have him thrown in jail and is there someway he can ask for a more reasonable payment plan? Also is there somewhere he can get free legal repsentation as he can't afford a lawyer at this point in time?
