Financial Advisor Stole Aunts Money

My aunts financial advisor admitted to spending the money on credit card debts, mortgage and other similar things. She also admitted that she paid the aunts interest from the new money the aunts were sending her to invest in a money instrument called debentures. She also stated that this was a loan made to her and that she did not have to pay it back. This lady is a one woman show and is the sole proprietor of this financial services business and is not affiliated with a broker dealer and recently surrendered her license. We did not meet this lady until the aunts brougth us into thier dealings and by then it was to late. We have had a lawyer working on this for four years and he states that we cannot pursue both criminal charges and try to get the money back. It has to be one or the other. This lady and her lawyer have in the past offered a settlement of $50,000 up front and $25,000 per year until the money is paid back in full. This is an insult seeing that she took 1.2 million dollars and either the aunts, the heirs or her will probably be dead before she could pay it back with that type of settlement. What can we do?

If she goes to jail you don't get any money but it makes you wonder where the money is comming from for the settlement. How long did this go on before someone noticed and are the authorities aware of this specifically, not just her license loss?
