What is the name of your state? NC
If a wife withdraws $ from her husbands checking acct , her name isn't on the acct in anyway, and she has been warned by the bank what she has done is illegal but she does it again and without the knowledge or permission of the husband. What are the legal ramifications of this?The husband wants to press charges, he wants a divorce, what route would you recommend?she has purposely hidden his bank statements, caused him to bounce checks due to these hidden withdrawals, when he has written out checks to pay bills she destroys the checks and the bills don't get paid. What type of evidence does he need to show besides copies of his checking acct statement with debts shown.

Let me understand you. the bank tells the woman she cant withdraw from hubby's checking account, then the bank lets her withdraw from the checking account? how is the bank explaining why they are allowing her to withdraw money?

hubby wants to pay his bills so he writes the checks and gives them to his wife who then destroys the checks? why is hubby giving the checks to the wife?

have hubby get a new checking account, new checks and have the checks and statements sent to a P.O. Box. have hubby also notify his credit card, mortgage and other billing institutions of his P.O. Box mailing address.

He got a PO box and she went behind his back and got the mail stopped from going to his POB and got it sent to hers. He would ask her to mail the bills and she evidently didn''t mail them.
The bank realizes they can be held liable for allowing her to withdraw money from his acct but what I want to know is what does the wife face legally if found guilty of this.
