What is the name of your state? Virginia

My husband was charged with Petit Larceny at Sears. He insist that he didn't do it and feels that getting the video surveillance tapes from Sears would be all the evidence he needs. We think it is that simple and therefore hestitate in hiring an attorney. As the defendant how do you obtain these records? A subpoena duces tecum does not seem appropriate since we would need the video from the time he walked in the store to the time he left. The subpoena doesn't allow for description of specific tape time and person on the tape. Do we need an attorney just to obtain the video tape?

Thanks
