punshment for health care fraud like 13,000 dollers... he was cashing check from the state when he wasent working for them no more he was a care giver at some ones home

There is too little information to even guess what kind of punishment it might be. It is safe to say that it would be a felony, however ... prison time, restitution, and a massive fine would be likely.

It's a felony, with a sentencing range of 16 months, 2 years or 3 years in state prison.

Depending on his background, the Dep Dist Atty may offer a county jail term, from one day (book & release) to one year in county jail. If this is in Los Angeles, they're doing 10 to 20 percent time on a county jail sentence.

PS: he would get a 50% good time/work time credit.
