here's a hypothetical situation...

an old man living alone places a chocolate bar laced with cyanide in his fridge (for whatever reason, we don't know). that night, a burglar broke into his place. getting tired and hungry from his looting, the burglar decided to get a snack from the fridge and ate the chocolate bar. that night, the burglar experienced symptoms of poisoning and confessed to his wife that he broke to this person's home and ate some food in his fridge. the next morning, the burglar died. autopsy shows that he died from cyanide poisoning.

a few weeks later, the old man was sued for involunatary manslaughter.

question, is the old man guilty or innocent? if innocent, did the old man commit any crime at all?

If this is a homework assignment you should state it from the get go, very politely. You are WAY more apt to get responses that way. I did, anyway.

and by the way, if it WAS cyanide poisoning, the burgler wouldn't make it out of the kitchen.
