Can someone get out of jail that has a probation hold until the hearing for probation revocation arrives? My question is why keep someone in jail that might be proven innocent and would be doing time for not breaking his probation? It seems unfair......This is taking place in Louisiana....

Oh my god! How weird. I have client right now going through the same thing. She is on probation hold in jail for two bogus felony charges -- no court order in place, never served. Unfortunately, because society takes probation seriously and parole officers take violations seriously, there will have to be a hold until criminal charges are dismissed. It is the only way to maintain the integrity of the criminal court/rehabilitation process.

Your best bet, get a criminal defense attorney to rep you at the prelim hearing and see if charges can be dismissed. If so, immediately inform the parole board to lift the hold.
