Legality of non-consensual distribution of naked pictures?

What is the name of your state (only U.S. law)? Pennsylvania (if not U.S.)

I have recently gotten access to naked pictures of some girls from my high school that someone is offering to give me. From what I can discern, the images were taken consensually, but the distribution of them isn't. The only law that I could find regarding it was 18 U.S.C. 1801, which at least to me doesn't explicitly state that non-consensual distribution is illegal, especially since the images were taken consensually (the source allegedly ran a modelling scam, so he could get the girls to take off their clothes under their own consent).

So, as long as the girls are at or above the age of 18 in the pictures, would I legally be allowed to have them?

General rule of common sense: If you have to ask if such an activity is legal or not, its probably not something you should be doing. Esp since the laws concerning what happens to such photos are changing to make it less and less legal to distribute them. Really, step away from the potential liabilities. If you want photos of naked women, find legal ones.

Also, if you know they were also OBTAINED illegally (your statements that the one who obtained them did so under a scam) then they are an even bigger liability and potentially even LESS legal. Again, step away from the illegal photos.

1. I'm going to ask first, and then once I get them, I'm going to run them through some software to see when they were taken. The one girl I've known since kindergarten, so if the picture was taken since we graduated high school, I can be certain that she was 18. The other two will require some research, but considering they were taken from a modelling company (even if it wasn't legit), I doubt they would let themselves get naked for pictures if they weren't 18. In the end, if I suspect that they are underage, I'll just delete them, and overwrite the pointers on my HDD.

2. I don't have a sister, my mother is really ugly/fat so I doubt anyone would want to see her naked anyways, but if you're into that then I guess so, and if it was my wife... well then I'd be more than happy to see the pictures (although, I suppose I'd have my own nudes of my wife if I had a wife, but who knows).

If you're finished with not knowing anything about psychological disorders and the ad hominem remarks, you mind telling me if this is illegal or not?

Seriously, I just want to know if it's illegal or not. This is a LEGAL forum, not a "let's protect our morals" forum.

1. You expect ethical behavior such as age verification from a man who is tricking them into a 'modeling' job? Also, are you under the assumption that IF they gave him "ID", that it was legit in itself? Fake ID does not absolve the photographer from child pornography.

2. I suspect by the time you are old enough to be married, this would trigger so much embarrassment at your teen behavior that you wouldn't be able to hold a camera straight.

It seems nobody in this entire situation has a brain.

It very well could be illegal. Why don't you take your photos down to the police station and ask them? There are millions of nude women online - do you really want to risk sex offender status for these?

I don't want to risk anything. That is why I am asking people on this site, along with utilizing software that will let me determine when the photo was taken, which will allow me to confirm the age of at least one of the girls involved due to my relationship with her.

The other two I think I'll pass on.

I don't see why I'm getting so much hate. I'm taking the time to be responsible and make sure that my actions aren't breaking any laws. I'm using resources at my disposal to make certain that my actions won't lead to imprisonment. Are people really that against porn on this site?

If you are friends with one of the girls in the photos then why don't you just ask her if its ok if you possess naked photos of her. If she says yes then things are fine n dandy. If she says no, well, guess you're going to have to find your potentially illegal porn elsewhere.


And btw, nobody here is really and truly against porn. We just prefer it to be legally obtained and distributed. You don't seem to have such ideals.

You could be in possession of child pornography right now - do you think "I didn't know" is a defense? It is not.

We're also telling him that yes, there is a HUGE chance this whole thing is illegal (not just for possible child porn). He doesn't seem to want to hear that since he continues to ask about the legalities of the situation.

It seems that this teenager also believes that only children can be sexually exploited. I'm also wondering if OP is 18 himself and if he intents to distribute this photo.

I'm wondering why, if OP is concerned about the models being underage, OP wouldn't very simply make a quick call to the police and let them investigate?
