What is the name of your state? ny
I'm not sure what fraud would fall under but i'll ask my question anyway. I got on welfare after my son's father was incarcerated, but his name wasn't on the birth certificate at the time so i stated that i didn't know of his whereabouts. After a few months we got his name on the birth certificate so he would have proof of having a child but i never put his name on the welfare application, i kept using the old birth certificate for recertification. Unfortunately now we are in a nasty custody battle and he is stating that i commited fraud and i read up on a couple of welfare fraud situations and my situation doesn't appear to be fraud. I mean it's not like he ever worked or given me any type of child spport and i don't work either. So i guess my question is, did i commit fraud and if so how much trouble will i be in??

There is another side that you can use against the child's father. When paternity is established in your welfare case, the state will come after him for a percentage of the welfare you received as back child support.

Since your child is 3 years old, why haven't you gotten a job when you've had all those years to apply?

As evidence of the failed welfare state, we had a foster child whom we still see frequently (a girl - 11 years old and already held back one year ... the max permitted by district policy here) who has expressed this attitude frequently:

"Why work when the government pays you to sit around the house and sleep all day?"

She will LITERALLY ask this! Her goal in life is to stop going to school as soon as she can, have a child as early as she can, and then collect a "paycheck" from the county, state and feds. She reasons that since her mother does this, why can't she?

Never mind that her father is a hard worker (he drinks too much now and then and occasionally does dope, but he holds a steady job and works diligently) and that they don't own anything and are always begging for extensions on their rent and begging for food from friends ... she sees this as something to aspire to!

The best thing someone can do for their children is to suck it up and get their tails to work. What a parent SAYS has far less an impact than what they DO (or, don't do, as in this case).

Once many years ago, in he course of my employment I visited the home of a welfare family, there were grandma, mom and her daughter and about 12 preschool aged children between them, they did quite well between section 8 housing, welfare, tuition aid, food stamps plus the clothing and food closets from local churches, nice shinny cars sitting out front, gifts from the unknown fathers, ah yes, the welfare state.

I don't know how they do it, but when I go into many of these homes, I often see big screen TVs, X-Box or Playstation games, a computer, nice stereo, Rent-a-center furniture, plenty of beer and cigarettes, rotted food and dirty dishes piled up in the sink next to the fast-food wrappers.

My house is cleaner, but they have more "stuff" than I can afford, and I work for a living and drive a 12-year-old Saturn with rust on the side!

Life ain't fair!

But you probably feed your children good food and you probably purchase cleaning supplies...those things add up...If you want the "stuff" just stop buying good food and let the house go to hell!! ;)

Yep, it is amazing, they had/have the system down to a science.

Oh come on! Not everyone on assistance is like that. Surprise surprise but I was on assistance through law school. I was going to law school and working and raising my daughter. I received food stamps and medical coverage. When I talked to my case worker about getting off assistance because I didn't need it anymore she asked why I would want to not have the state cover me. I told her because the purpose of me going to law school was to not have to get assistance and support myself! I used the system temporarily after my divorce to make a better life for my family.
So just remember that some people out here who get welfare use it as it is meant to be used. I paid into it for many many years and I am now again paying into it. But when I needed it I took advantage of what was offered. But I did it honestly.
OP you on the other hand committed fraud. Good going. Lying to the government is FRAUD! You received benefits fraudulently.
