The prosecution listed in their discovery many items,
however one of the items listed was not there. The
Audio-Video DVD of me being questioned at the police
department is missing.

The prosecution says they don't have it..

If they did not have it, then why would they
have listed it.

My attorney says this happens all the time and
that most likely it was removed to limit liability
to a civil rights violation as it clearly showed they
violated my Civil rights.

Any Ideas?


My Attorney says no big deal, but to me it's a big
deal as it had me on the tape and if I make any
statement that is different than what is on that
tape I'll bet it shows back up..

We deposed the Detective, in that he clearly did
not remember alot of things that were said on that
tape..

Any recourse? Do Interogation videos really just disappear
on accident?
