The Pastor of our local Houston church was falsely accused and wrongly convicted w/10 year sentence for fondling a now 26 year old and 23 year old female(s). The Pastor and his family are financially wiped out and he is currently serviing time in county waiting a transfer to State. His court appointed attorney has appealed. There was no evidence provided and our Pastor refused to accept plea bargains and took his chance with trial by jury. He was found guilty - only on testimony. These girls denied on the stand that their impetus to file years later was monetary - however immediately after his convinction they both filed civil lawsuits, multi million (each) and are suing both the pastor and the church.

The State is now 45 days late filing their brief for their comments on the appeal - they are requesting a motion for extension

Question- can they do that being 45 days late past their 30 day deadline? Can it be contested by the lawyer? He has no intention of appearing in court. Is there anything we (congregation) can do?

Question-is it possible to get him put on 'house arrest' with an ankle braclet? How do we do that?

Question-is it possible for him to get out on a bail - even though he is indigent? If the congregation raises his bail will that hurt him in court if we do that? How do we get him out?

His court appointed attorney seems uninterested in helping. Can we write letters and petition the court to plea for his release? What if anything can we do?

O.K. so why is their filing a civil suit relevant?
Question- can they do that being 45 days late past their 30 day deadline?
Yes
Can it be contested by the lawyer?
Yes
He has no intention of appearing in court. Is there anything we (congregation) can do?
Pray
Question-is it possible to get him put on 'house arrest' with an ankle braclet?
yes
How do we do that?
You don't. The courts do.
Question-is it possible for him to get out on a bail - even though he is indigent?
Yes
If the congregation raises his bail will that hurt him in court if we do that?
No way to know the answer to that.
How do we get him out?
you don't. If bond hasn't been ordered by the court, you can't 'buy' his freedom.
His court appointed attorney seems uninterested in helping. Can we write letters and petition the court to plea for his release?
Sure, but it's meaningless.
What if anything can we do?
Pray.
