What is the penalty or criminal charges if a guy is with a friend and that friend steals a wallet with a debit/check card. The friend gains access to the pin number, then goes to the ATM machine and takes out $300. If the guy takes some of that money, what does he get out of it? I mean like jail time/fines.

probation and restitution if first offense maybe community service say 50 hour,depending on state and if friend shows remorse.

It depends upon what the DA charges. The "friend" can recieve anything from being charged with robbery and or theft.
