payday loan company pressing criminal charges

What is the name of your state? Oregon
I have been contacted by a law firm representing a pay day loan company that I have defaulted on a loan. They are stating that they are filing charges against me for Fraud and Theft with the state of Oregon. Can I be arrested for this? The company will not even accept payment for this loan now, the law firm states they want to "make an example out of me" " they dont want the money now they want consequenses" I dont have money to hire an attorney, what should I do? Should I be worried about being arrested?What is the name of your state?
 


These payday loans places are barely legal in the first place and are more preditor than anything I would find legal advice and soon

Did you actually default on the loan? or did you submit a phony check or a check with insufficient funds?

The violation of a civil agreement is not generally going to result in criminal charges. The police are not going to go after you for defaulting on a loan. However, if it can be shown that you intentionally committed some fraudulent act in obtaining the money, they just might go after you. The fact that they do not appear to be interested in payment seems to indicate that they believe you committed some provable fraudulent act.

Consult local counsel immediately.

I concur if you had simply defaulted it would be civil issue. However if you presented them with a NSF check or a check written againist a closed account you could be in serious trouble! Call a Lawyer should be your next move!

I probably have 4 or 5 unpaid payday loans and never paid them... But that was in Idaho. I just had too many out at once. My husband use to always deposit his paychecks into my account and one day the bank decided they would not accept his check. They said it could have been stolen?? lol we had the same last name, and our adresses matched, and when he went into the bank they would not talk to him because it was not his account even though it was his check! They said they would send his check back to him and he never got it... Meanwhile Since we were relying on his money to pay the bills we couldn't because of what the bank did, and then every check that went into our account bounced.. The bank also decided they were going to keep running the checks through so before we knew it we had $1000 in over draft fees! I never paid them either... Im suprised the bank never reported me to cheksystems and it never hurt my credit... But because they decided to be jerks one day it messed up all our loans, and I never got threatened like you...
