What is the name of your state?From Ohio - I will make this short and simple. I took a loan out with a payday loan company, I was not able to pay the loan when it was due. They deposited the check and it went back to them. Now in their collection attempts they are threatening to file charges on me. I am not usually a deadbeat, but am unemployed and fighting not to lose things like my house and car. Anyhow...are they able to file criminal charges? I thought I had been told once that they could only sue you. Thanks for any help!

Don't ever go to one of these payday loan "sharks"!

How lucky do you feel?

No, they probably cannot support a criminal charge against you UNLESS they can demonstrate some form of intent to defraud. However, your state may have laws permitting criminal charges in the matter. In my state, the chances of criminal charges being filed would be slim to none.

It is probably a bluff ... but how much of a chance are you willing to take?

If your trying to save your house and car and solve this problem at same time, go to a lawyer and file chapter 13.
