paying restitution after it is out of State of Washington jurisdictionMy husband paid restitution on some offenses he did in 1986. He paid on them for 10 years. The state of Washington lost jurisdiction on them in 1996 and we stopped receiving payment invoices on them but there was still a balance owing. Now 5 years later, they are trying to collect on them again. Is this legal??? What could/would happen if we just ignore them??? The debt is 15 years old. |

| The statute of limitations in Washington on court ordered restitution is 10 years. The clock starts at the time of your last payment, not when the court order was given. Ignore them and they will garnish your husbands wages, clean out any bank accounts and even take any tax returns. |

Still confused about restitutionSo are you saying that the clock on the statute of limitations starts over every month if you make payments once a month?? Or are you saying that the clock starts on your first payment made and then runs out after 10 years from that?? |

| The clock starts over every time you make a payment. If your last payment was made in November of 1996, the 10 year period ends November of 2006. And you did not mention what the offense was but if the offense was a felony and the order for restitution was part of the sentence, their is NO statute of limitations. It is considered a lifetime debt and there are only 2 ways out, pay the debt in full or die. |
