What is the name of your state? New York

Hi,
Is it illegal to pay people to watch them have sex together in your own home? I would not be having sex with them. I would just be a paying voyeur. I met them over an internet forum.

**A: it depends on how much they are charging, whether you pay by cash, check or credit card, if tickets to the event will be scalped, if the "people" will be of the same sex or opposite sex, if they will be using protection and if you get the reserved seat that you contracted for.

Well, they will come to my home. There are no tickets so no scalping. The pay will be 400 dollars cash. I will be the only one watching except possibly my girlfriend. They are a man and a woman and they don't use protection.

**A: would that be $400 per person or for the couple? And would your girlfriend be paying also or would she be free?

I am NOT an attorney.

Based strictly on your description of the intended event, the answer to your question is, yes it would be illegal.

Are you sure they are what they say they are anyway? I have this bridge.......

Yes, we would both be paying 200 for a total of 400. They will come over, we will give them the money. Then we will watch them have sex. What law is this in violation of?

This for starters:

S 230.15 Promoting prostitution; definitions of terms.
The following definitions are applicable to this article:
1. "Advance prostitution." A person "advances prostitution" when,
acting other than as a prostitute or as a patron thereof, he knowingly
causes or aids a person to commit or engage in prostitution, procures or
solicits patrons for prostitution, provides persons or premises for
prostitution purposes, operates or assists in the operation of a house of
prostitution or a prostitution enterprise, or engages in any other conduct
designed to institute, aid or facilitate an act or enterprise of
prostitution.

S 230.20 Promoting prostitution in the fourth degree.
A person is guilty of promoting prostitution in the fourth degree when he knowingly advances or profits from prostitution.
Promoting prostitution in the fourth degree is a class A misdemeanor.

Oh, let me edit to add the New York definition of prostitution just so you will have all applicable definitions before you.

230.00 Prostitution.
A person is guilty of prostitution when such person engages or agrees or
offers to engage in sexual conduct with another person in return for a fee.
Prostitution is a class B Misdemeanor.

Any act done for sexual gratification or that one party may receive sexual gratification from for money or other valuable consideration may be considered prostitution.

Paying someone to watch them take a shower has been held to be soliciting prostitution. No touching involved. The key in non physical events is the expectation of sexual arousal.

The two people engaging in sex acts are guilty of prostitution. You and your friend are guilty of soliciting prostitution and maybe pandering. You are all guilty of conspiracy.

Thanks a lot guys. It seems to be something like an escort service except slightly differentt. Isn't it usually quite tricky to prosecute something such as this. If the pretense for giving the money is for traveling expenses, is this still prostitution? Would I need to produce proof that it costs 400 to travel.

Just to clear it up. Is it considered prostitution to pay a seperate party to have sex with eachother. They are going to do it anyway, so why is it prostitution if I simply give them some "traveling money"
Let me help make it easier for you to read by deleting parts. First the couple is engaged in prostitution. 230.00 Prostitution.
A person is guilty of prostitution when such person engages or agrees or offers to engage in sexual conduct with another person in return for a fee. You are paying him and her for their agreement to engage in sexual conduct with each other. Therefore they are engaging in prostitution

Next step: You not only furnish the money but the place for the prostitution to occur. 230.20 Promoting prostitution in the fourth degree. A person is guilty of promoting prostitution in the fourth degree when he knowingly advances . . prostitution. Now what is "knowingly advances?" Well, the definition, deleting the inapplicable, portions is "A person "advances prostitution" when,
acting other than as a prostitute or as a patron thereof, he knowingly
causes or aids a person to commit or engage in prostitution, (your paid them) . . . or . . . premises for
prostitution purposes (it will be done in your home. . . .

Clear?

My point in asking your previously if they are who they say they are, is:

#1 You said you found them on the internet
#2 From your questions and answers, forgive me, you appear way in over your head.
#3 With the child porn, raids, and all. What if when they show up and you give them the $, and what happens if suddenly, Shirley and Bob become Patrolman Bob and Sergeant Shirley?

"Yes, your honor, they told me they needed $400 in travel expenses to get to and from the station house. They were very nice to me, though, didn't charge me an extra cent for letting me ride back with them!"

Since paying to watch adult movies either on line/tv/or video is legal... would it be legal to have a couple hire me as a videographer and me to hire two consenting adults to have sex in a private environment on film and then give that same couple the tape and payment? Would this be a "legal" loophole in WISC. if a contract were signed by all parties? I have several couples interested in this arragement but want to make sure it's legal...thanks!

You need to start a new thread of your own and not necropost. Putting your situation on someone else's (old) thread is frowned upon.
