OK about two months ago my husband lost his job and has been extremly stressed out. He's been drinking a lot. Normally my husband is the nicest guy and has never ever hurt me(in the 6 years we have been together). He has no criminal record. Well about two weeks ago he was so drunk he could barely stand up, he was literally going crazy and attacked me. He did this in front of our 3 year old child. I never went to the police because it was the first time and I know it was the alcohol not him. Well a couple nights ago he was drunk again and started yelling, he did not hurt me, again it was the alcohol talking. I called the police. I told the police what was going on, they had asked me if my husband had ever hurt me before and I told them what had happened the week before. Then they questioned my three year old daughter. She told them her daddy gave me a bloody nose before(which is true, I get bloody noses easily and one time I did run into his elbow while in bed), she also told the police that she went to school, and she doesn't.. They asked him to leave our home but did not tell me he would be arrested, infact they made it sound like he just needed to cool off. He never came home the next day, then that evening I got a call from his mother, who lives 600 miles away asking me what was going on. I guess he had been arrested and I didn't even know! He can't call me because they can't make calls to cell phones. I called the jail they told me what his charges were, Assault IV which is a felony in Oregon, and strangulation. The man I talked to was extremly rude to me... Im not some women who constantly gets beat up by her husband and is too stupid to leave.. This only happened once. My question is how can they charge him with these crimes? What proof do they have? I will not testify against him, I didn't have brusies all over my body, I had one tiny small bruise, they took a picture but I dont think it will even show up in the picture. I mean its not like it happened then he got arrested, it happened the week before, and they arrested him off of what I had said.. How can my daughter be used as a witness? She is 3 and she also told them she went to school and she doesnt.. And he never strangled me! He put his arm around my neck but not strangling me! Can he even be charged? His pre-trial is in a week, What do you think will happen?
