What is the name of your state? NY

My male cousin (waiter) recently got into a scuffle with a female co-worker (waitress) in their restaurant. She was upset with him for some reason (he wasn't very nice to her), and at one point wanted to talk to him outside. He refused, and she proceeded to hit him. For one of the blows, she went for his head, and in a defensive posture he stuck out the top of his head to absorb the blow.

Unfortunately, the two collided when she moved in to deliver the strike. Her mouth hit the top of his head. As a result of the exchange, he received several bruises on his face, and he may have gotten a loose tooth.

Several days later, he was summoned to the police station, where he was told that he had to show up for a court date. The tragic part of the whole affair is that he is an illegal immigrant.

My question is, what is the pupose of this court date, and does he need a lawyer? And more importantly, is he at risk of being deported? He does have a US diver's license.

Thanks for any replies.
