A director paying an actor to perform sex acts is not doing it for his sexual gratification and he is not physically involved. He might be charged with pandering and conspiracy possibly.

Using your "director" example, if it were true, would make anyone paying to see the movie guilty of prostitution.

Besides, you have the concept of "art" and "freedom of speech" in the director example.
