What is the name of your state? PA

Can a prosecutor continiue a case because they have to gather more evidence when the trial is only a day or two away? If so what is the right to a speedy trial? Can a lawyer fight and have it either go as scheduled or dismissed? Thanks

Are you (or the accused) not already represented by counsel? It would probably be prudent to pose this question to the defense attorney.

Do you mean the actual trial, or a Preliminary Hearing?

Preliminary Hearings are often continued for various reasons, although the vast majority of the time, evidence is fully gathered prior to the filing of the charges.

County courts work on a trail term schedule. In other words, criminal trials are only held every few months. It is highly unlikely that a DA's office would ask to continue an actual trial, and even less likely that it would be granted.
