Sex offender hasn't registered, children in home

A friend's uncle was convicted of a 311.a for child pornography. He completed community service, but left the state without permission while still on probation to care for an ailing relative. These ailing relatives have knowingly allowed him to live there. Not only did he leave the state, he was also supposed to be registered as a sex offender, and he had an outstanding dui.

There are minors in the home at times, who have to stay there since their parents are working, and the parents of these minors are concerned that they are violating the law by participating in this "family secret", and could even be at risk of losing custody of the children for allowing them to stay in this home where the criminal is being housed.

Are they breaking the law by not speaking out about this person? Is he allowed to be near minors, in the same house? And do the parents risk losing custody with their children in the home? (Note this is not their home where the man is living, but in the home of another relative).

What state did he come from? What was the offense (statute number) for which he was convicted? What state is he now in?

If he is not a parolee at large and is not violating probation or parole, then the only crime MIGHT be if the state he is currently in requires him to register for his conviction in the first state.

The crime was committed in CA. The offense code was 311a (we think). He is now in GA. He DID leave the state of CA while still on probation -- without permission. And he is supposed to be registered as a sex offender.

My question is about the other family members who know about this, and have allowed their minors to be around him--are they violating the law?

The other parents are likely not violating the law, but the guy who is there in violation of probation and has failed to register in GA (if required) then HE is breaking the law. I have not looked up the law in GA but if a conviction for possession of kiddie porn in CA is sufficient to require registration in GA than he is breaking the law by not registering.

The other parents might be guilty of aiding his continued crime of failing to register, but I am not familiar with GA law so do not know if there is a crime for that. And if the kids are injured or molested, and the parents knowingly put the kids into danger with this man, then the parents could be charged.

Perhaps you can call the cops and let them know where this guy is? If he has a warrant from CA and has failed to register in GA they might be very interested in yanking his chain.
