My wife was accused of shoplifting this morning at a local Walmart. We have a 2.5 month old child that was in a carseat in the cart, while shopping she took a blanket off the baby to feed her and laid the blanket in the cart which covered a couple small items totaling about $22, she then checked out at the electronics section to purchase a video game and then checked out at the front of the store with several other items. While leaving she gave her receipts to the exit checker who asked if anything was under the blanket, she said i don't know and picked up the blanket revealing the items. She was then escorted to the back of the store where police were then involved. She was told that someone had to come get our daughter or she would be taken by police if someone was not found while she was being processed. She called me but i did not answer, she then called her parents who came up to get the baby, all the while the baby was crying because of a dirty diaper and was hungry but they would not let her tend to the child. The police then gave her a court date and she was told there would be a fine. And also gave her a copy Stealing and related Offenses Section 570.087 which states she will also be asked to pay a fine to wal-mart between $100-$250. She was then told to go to the front of the store, which she did, at that time she was told she could leave, all while still having the child.

Do we have any defense in this case? She has NO criminal record, but can now no longer shop in wal-mart (for how long I'm unsure). Will this go on her criminal record? How much should we expect to have to pay on top of the Civil Liability, as far as court fee's and such? If she's aquited are we still responsible for Civil Liability fees? is there anyway she can be allowed back into a wal-mart stores, also does this effect Sams stores also?

I am in a wheelchair and require assistance while shopping, well seeing as we are married she is normally my assistance, does this now mean she cannot assist me in shoping also? and since we are married am i now barred from the store or does this only account for her?

Please advise.
