What is the name of your state? Illinois

I was charged with aggraved battery, a felony, in IL. The states attorney is thinking about dropping the charges of aggravated battery and dismissing that case and charge me with reckless driving, a misdeameanor. My question is how long does the state have to do this? And is the date from the original charge..Or is it from the date of the incident or is it from the date of the dismissal?
